1. General
- 1.1. SAFRA Swim For Hope 2023 is organized by SAFRA National Service Association (“Organiser”) in accordance with these Rules & Regulations ("Terms") that is applicable to the Participants, which can be found at www.safras4h.sg (“Official Website”).
- 1.2 The Organiser reserves the right to amend the terms and conditions without prior notification.
- 1.3. The Organiser reserves the right to cancel or postpone the event without any prior notification, in which case, the fees are non-refundable.
- 1.4. By registering for The Event, you confirm that:
- the information provided by you is true and correct;
- you consent to SAFRA's collection, use and disclosure of your personal data for the purposes of organising and managing The Event [including but not limited to contacting you via email and short message service (SMS) on the Event, posting the swimming and fund raising results on The Event's portal, and transmitting your personal data to third parties engaged or working in collaboration with SAFRA such as our beneficiaries (SAF Care Fund/ Singapore Aquatics/ Singapore Children's Aid Society/ Care Corner Singapore/ President's Challenge) for the purpose of issuing Tax Deductible Receipts (if applicable)] and for other applicable purposes as set out in SAFRA's Privacy Policy (https://www.safra.sg/privacy-policy), as amended from time to time, which outlines how SAFRA manages your personal data in accordance with the Personal Data Protection Act 2012;
- where Personal Data of any third party is provided by you, you have obtained the consent of the third party to SAFRA's collection, use and/or disclosure of those Personal Data;
- You are solely responsible for the personal data that you provide or disseminate, notwithstanding that the dissemination is via third party platforms, including but not limited to SAFRA's Facebook page and WOBS, and your personal data may also be subject to the personal data policies of such third party platforms.
- 1.5. Registration ofThe Event will be made via our appointed service vendor, WOBS (Wobs Pte Ltd).
- 1.6. Photographs, videos and other recordings ("Media") will be taken by The Organiser at The Event. By attending The Event, whether as a participant, staff or volunteer, you consent to and grant The Organiser the right to use such Media for internal records purposes, publicity purposes, commercial advertising and distribution to its sponsors and partners.
- 1.7. Please note that non-official photographers might also operate at this event. SAFRA has no control over and is not responsible in any way for any Media produced by non-official photographers.
- 1.8. By registering for The Event, you agree to abide and be bound by the SAFRA Swim For Hope's Terms and Conditions and agree to undertake to settle all debts incurred arising from SAFRA Swim For Hope 2023 and any of the SAFRA activities participated by you and/or any of your family members, including membership fees incurred by your spouse/child/children.
- 1.9. SAFRA reserves the right to revoke my application(s) without refund, if the information given is found to be inaccurate or misleading.
- 1.10. The Organiser reserves the right to amend these Terms from time to time without giving prior notification or any reasons thereof.
2. Registration
- 2.1. Participants below the age of 12 must have sought parental or guardian consent before participating in SAFRA Swim For Hope 2023. The Organiser has the absolute discretion to reject and refuse the registration of a potential participant without assigning any reason to the participant, and to terminate such registration for any reason whatsoever. By agreeing with the Terms and Conditions, participants would undertake the risks from participating in SAFRA Swim For Hope 2023.
- 2.2. The Organiser reserves the right to cancel or postpone SAFRA Swim For Hope 2023 at any time. The Organiser may, but is not obliged to notify the Participants of such cancelation or postponement. If SAFRA Swim For Hope 2023 has to be cancelled or postponed, there shall be no refund of registration fees paid and the Organiser shall not be liable for any other loss or inconvenience caused.
- 2.3. Participants must provide true, accurate, current and complete information about the participant in the online registration. If a participant provides any information that is untrue, inaccurate, not current or incomplete, or ifThe Organiser has any grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the participant's registration may be rejected or terminated without notice.
- 2.4. Registration and addition of team members for Team Category will not be accepted after the closing date of 30 Sep 2023, 23:59hrs.
- 2.5. Upon successful registration, participants are not allowed to change the category that they have registered for.
- 2.6. All category registrations are non-transferrable and non-refundable.
- 2.7. Participants are to ensure that their home address are indicated accurately if they have chosen home delivery option for entitlement arrangement. This is to prevent any mistaken delivery of entitlements to other home addresses.
- 2.8. Entitlements will only be delivered to local addresses for home delivery option. Overseas participants are advised to send their entitlements to local addresses.
- 2.9. The Organiser reserves the right to close registration before the official closing date should participation reach its capacity limit.
- 2.10. The Organiser will not be responsible for any dispute arising from incomplete or incorrect information submitted by participants.
- 2.11. Completion of the online registration form evidences the participant's agreement to abide by the Terms and Conditions of SAFRA Swim For Hope 2023.
- 2.12. The Organiser reserves the right to limit and refuse entries.
- 2.13. A confirmation email will be sent to the participant's email address after registration is successfully completed.
- 2.14. The registration will only be completed when full payment is made.
- 2.15. There shall be no refund of any registration fees to any Participant who does not in due course take part in the event, for any reason whatsoever.
- 2.16. The Organiser reserves the right to replace the swim pack items with items of similar value.
3. Swim Mechanics For Event
- 3.1 While every reasonable precaution will be taken by The Organiser to ensure participants' safety, participants are advised to exercise due care and The Organiser shall not be liable for any loss and/or damage, whether personal or otherwise, and howsoever arising.
- 3.2. SAFRA Swim For Hope 2023 swim mechanics are full virtual swim, full physical swim and hybrid (virtual with completion of 1KM of physical swim at SAFRA Club).
- 3.3. The event period for SAFRA Swim For Hope 2023 will be from 1 Sep 2023, 09:00hrs to 29 Oct 2023, 18:00hrs (for virtual and hybrid option). Physical swim event occurs at selected weekend in Oct 2023 with the following Schedule:
- 14 & 15 Oct 2023 at SAFRA Choa Chu Kang
- 21 & 22 Oct 2023 at SAFRA Toa Payoh
- 28 & 29 Oct 2023 at SAFRA Tampines
- 3.4. Participants are solely responsible for providing, at their own expense, all equipment necessary to access the Swim For Hope, including but not limited to a computer and their own internet access (including payment of third party charges associated with such access, as applicable). Participant's use of any software application in connection with Swim For Hope is solely at the participant's own risk and may further be subjected to the relevant third-party service provider's terms and conditions which the participant should carefully review. The participant shall be responsible for maintaining the confidentiality of their passwords and accounts with the third-party service provider and for any and all statements made and acts or omissions that occur through the use of the passwords and accounts, including any mail or other forms of communication sent and any charges incurred.
- 3.5. Participants below the age of 12 are required to seek parental/guardian consent and fill up the relevant indemnity form when registering online, failing which, the Organiser reserves the right to refuse entry to that Participant.
- 3.6. All participants will have to complete and submit the distance swim before 29 Oct 2023, 18:00hrs.
- 3.7. A participant's failure to observe the Terms and Conditions may result in disqualification.
- 3.8. Any disputes arising from the participation in the Swim For Hope shall be referred to Arbitration to be conducted in Singapore under the law of Singapore Arbitration Court.
- 3.9. All participants will receive participant t-shirts and goodie bags, and those who have successfully complete the category distance that they signed for will be awarded a Finisher's Medal.
4. Safety & Medical Advisory
- 4.1. Participants are responsible for their involvement in SAFRA Swim For Hope 2023. The Organiser, the event sponsors/partners and their respective subsidiaries and affiliates, and the officers, directors, employees, agents, representatives, successors, assignees, and insurers of such entities will not be liable for any injuries, mishaps, sickness, death and/or loss/damage to personal property that may occur during or otherwise arising from SAFRA Swim For Hope 2023. Participants need to be aware that their participation in SAFRA Swim For Hope 2023 may be physically demanding and may involve a certain amount of risk and in choosing to participate, participants acknowledge that they accept all risks associated with participation in SAFRA Swim For Hope 2023 and that such acceptance is a precondition to their participation. Participants understand that they will have to co-operate fully with The Organiser and diligently comply with all safety instructions, directions and requirements.
- 4.2. Participants shall not hold The Organiser, the event sponsors/partners and their respective subsidiaries and affiliates, and the officers, directors, employees, agents, representatives, successors, assignees, and insurers of such entities liable for any damage to or loss of property or any injury or loss of life which may be sustained by the participant during the course or arising from any cause in connection with their participation in SAFRA Swim For Hope 2023.
- 4.3. Participants acknowledge the disclaimer waiving all claims against The Organiser, the event sponsors/partners and their respective subsidiaries and affiliates, and the officers, directors, employees, agents, representatives, successors, assignees, and insurers of such entities within the framework of SAFRA Swim For Hope 2023.
- 4.4. Should any participant feel unwell while attempting to complete their swim activity during the event campaign, he/she should stop and seek immediate medical attention at any medical facility.
- 4.5. Participants should prepare themselves adequately and gradually increase the duration and intensity of their training over several weeks prior to the event campaign.
- 4.6. Participants should ensure that they are well-rested and well-hydrated prior to any swim during the event campaign.
- 4.7. Participants are advised not to swim should they have fever, cough, breathing difficulties or severe muscle ache during the event campaign.
- 4.8. Participants are advised to consult their medical practitioner to certify them fit to participate in the event.
- 4.9. Participants who have doubts about their suitability to participate in this event (e.g. those on medication or those who have had recent health conditions) are advised to consult their medical practitioner prior to participation in the event.
- 4.10. To minimise injuries, always do at least 15 minutes of warm-up/stretching before the start and at the end of swim.
- 4.11. Participants are advised against the consumption of alcohol or stimulants or any kind of drugs within 24 hours of any run.
- 4.12. Participants are strongly encouraged to go for a medical examination and/ or consult their medical practitioner prior to registration and before the actual event.
5. COVID-19 Advisory
- 5.1. Participants are advised to strictly adhere to the prevailing advisories and safe management measures mandated by the government while undertaking SAFRA Swim For Hope 2023 to keep themselves and the community safe from the spread of COVID-19. As SAFRA Swim For Hope 2023 will be undertaken by participants within public spaces at his/her own discretion, participants have to take personal responsibility for their own safety and act responsibly. The Organiser, the event sponsors/partners and their respective subsidiaries and affiliates, and the officers, directors, employees, agents, representatives, successors, assignees, and insurers of such entities, will not be liable should there be any breaches of the prevailing advisories and safe management measures by participants beyond SAFRA's premises.
- 5.2. Participants who took their dose of mRNA COVID-19 vaccines are advised to avoid any physical fitness activity one week after vaccination.
6. Use Of Personal Data
- 6.1. By registering for The Event, you confirm that:
- the information provided by you is true and correct;

- 6.5 With respect to your information, you warrant and represent to SAFRA that any information provided by you which will include your personal data (or any materials contained therein): (i) shall not be false, inaccurate, or misleading; (ii) shall not be fraudulent, inaccurate, incorrect, or untrue; (iii) shall not infringe any third party's copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy; (iv) shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising); (v) shall not be defamatory, libellous, offensive, unlawfully threatening, or unlawfully harassing; (vi) shall not be obscene or contain child pornography or anything adult in nature or harmful to minors; (vii) shall not contain any viruses, Trojan horses, worms, time bombs, cancellous, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information; (viii) shall not create liability for SAFRA or cause SAFRA to lose (in whole or in part) the services of SAFRA's ISPs or other suppliers; (ix) shall not contain materials that are religious and political. Furthermore, you may not submit any information (including your personal data) on the SAFRA Website or SAFRA's Facebook Page that could cause SAFRA to violate any applicable law, statute, ordinance, or regulation.
- 6.6 You hereby grant SAFRA a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to use and to exercise the copyright and publicity rights you have in your information and materials submitted by you for the Contest ("submission"), in any media now known or not currently known, with respect to your information.
- 6.7 You shall not assume a false identity or the identity of any other party or transmit libellous, harassing, vulgar, or otherwise objectionable messages; or post materials subject to copyright or other intellectual property rights claimed by any third party.
7. Coverage
- 7.1. Each participant, in participating in The Event: (i) agrees to take part in any and all marketing, promotional, publicity exercises with respect to the Contest; (ii) agrees for SAFRA to use his/her name, voice, photograph, likeness or other personal identifiable information in any media for the promotion and publicity ofThe Event and/or SAFRA products; and (iii) grants to SAFRA all consents and waivers necessary hereunder, including in respect of any promotional photographs and/or audio/ video recordings taken in respect ofThe Event.
- 7.2. Each participant agrees that SAFRA shall be at liberty to publish, promote, copy, reproduce, transmit, display, edit, adapt, modify, create derivative works of and/or otherwise distribute or use his/her particulars (including any publicly available lnstagram or Facebook profile photo and details) and/or the submissions (or any part thereof): (i) in connection with The Event and/or SAFRA products; (ii) for the promotion and publicity of SAFRA events and/or SAFRA products; (iii) in any manner, format or media whether now known or hereinafter created, and in any part of the world, including without limitation on online platforms such as Facebook, lnstagram, Twitter, and YouTube; (iv) at SAFRA's sole and absolute discretion; and (v) royalty free and without any obligation of attribution or consent.
- 7.3. For the avoidance of doubt, SAFRA expressly reserves the right to adapt, edit and/or modify each submission to include any logo, branding, name, mark, product image in respect of any submissions or such derivative work thereof, for any promotional or marketing purposes of SAFRA branding and/or products.
8. Tax Exeption
- 8.1. SAFRA Swim For Hope 2023 is an event organized by SAFRA Tampines to raise funds to support its beneficiaries.
- 8.2. All monetary donations to registered charity qualify for tax relief in Singapore. The nett amount donated through donations and crowdfunding will be eligible for tax exemption of 2.5x.
- 8.3. Registration fee or Fee for addition of team members will not be eligible for tax exemption.
- 8.4. For donors who would like SAFRA to submit on their behalf for tax exemption, their full name and full NRIC number will be shared to the beneficiary for the purpose of issuing Tax Deductible Receipts.
